ASA Submits Comments on Proposed WOTUS Repeal

The American Soybean Association (ASA) submitted comments to the Environmental Protection Agency (EPA) on the proposal to repeal the 2015 era Waters of the U.S. (WOTUS) rule this week. The proposed withdrawal would temporarily reinstate the pre-2015 rule while the EPA and Army Corps of Engineers (Corps) work to develop a new rule to replace it.

ASA applauded the repeal saying that it “recognizes the severity of the flaws in the 2015 proposal and the burden it would have put on farmers and individual landowners.” The comments went on to urge the EPA and Corps to work quickly and collaboratively with stakeholders to develop a new rule that creates certainty for the agriculture industry and clarifies the scope of regulatory jurisdiction which is limited to “navigable waters” in accordance with the law.
