EPA Releases Proposed Rule on Waters of the U.S.

The U.S. Environmental Protection Agency on Tuesday released its much-anticipated proposed rule clarifying the agency’s jurisdiction over waters of the United States under the Clean Water Act. The 371-page proposed rule can be read in its entirety here.

Although ASA continues to review the language in the proposed rule, EPA Administrator Gina McCarthy has given her assurances to ASA and to other farm groups on multiple occasions that the majority of farm operations will fall under current agricultural exemptions in the Clean Water Act. Additionally, EPA issued a fact sheet on the agricultural implications of the proposed rule, which can be viewed below. Among other items, that fact sheet outlines what would and would not change for farmers under the proposed rule.

ASA will review the proposed rule in its entirety to discern any additional impacts it may have on soybean farmers.
